Der Vollstreckungsbescheid des Amtsgerichts Hagen vom 04.03.2011 (Az.
xxxxxx) wird aufrechterhalten, soweit die Beklagte darin zur Zah-
lung von 1.774,40 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem
jeweiligen Basiszinssatz seit dem 04.01.2011 verpflichtet worden ist. Im Übri-
gen wird er aufgehoben und die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 62 % und die Beklagte zu
38 %.
Das Urteil ist vorläufig vollstreckbar, für den Kläger aber nur gegen Sicher-
heitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrages; die
Vollstreckung aus dem Vollstreckungsbescheid darf nur gegen Leistung die-
ser Sicherheit fortgesetzt werden. Der Kläger kann die Vollstreckung durch
die Beklagte durch Sicherheitsleistung in Höhe von 120 % des für die Be-
klagte aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht
die Beklagte vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils
zu vollstreckenden Betrages leistet.
