Tenor

Der Beklagte wird verurteilt, an den Kläger 2.778, € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz sowie außergerichtliche Rechtsanwaltskosten von 316,18 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 11. September 2010 zu zahlen. Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 31 % und der Beklagte zu 69 %.

Für den Kläger ist das Urteil gegen Sicherheitsleistung von 110 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.

Für den Beklagten ist das Urteil vorläufig vollstreckbar. Dem Kläger wird nachgelassen, die Vollstreckung gegen Sicherheitsleistung in von 110 % des vollstreckbaren Betrages abzuwenden, wenn nicht zuvor der Beklagte Sicherheit in gleicher Höhe leistet.
