für R e c h t erkannt:

Die Beklagten werden als Gesamtschuldner verurteilt, den Kleingarten Nr. 00 der Kleingartenanlage "E e.V." An der W-Allee, 00000 E, zu räumen und geräumt an den Kläger herauszugeben.

Die Beklagten tragen die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagten dürfen die Vollstreckung des Klägers durch Sicherheitsleistung in Höhe von 2000 € abzuwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leistet. Die Parteien dürfen die Sicherheitsleistung durch Bürgschaft einer Bank oder Sparkasse mit Sitz in der Bundesrepublik Deutschland erbringen.
