Die Beklagte wird verurteilt, an den Kläger 260,00 EUR (in Worten: zweihundertsechzig Euro) nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 21.07.2012 und aus weiteren 100,00 EUR vom 21.07.2012 bis zum 17.08.2012 sowie vorgerichtliche Rechtsanwaltskosten in Höhe von 83,54 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 21.07.2012 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits hat die Beklagte zu tragen.

Dieses Urteil ist vorläufig vollstreckbar.

Ohne Tatbestand (gemäß § 313 a Abs. 1 ZPO).
