Tenor

Der Beklagte wird verurteilt, an die Klägerin 61,64 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 08.09.2012 und 8,- € vorgerichtliche Kosten zu zahlen. Im Übrigen wird die Klage wird abgewiesen.

Die Kosten des Rechtsstreits werden gegeneinander aufgehoben

Das Urteil ist vorläufig vollstreckbar. Beide Parteien können die Vollstreckung der jeweils anderen Partei durch Sicherheitsleistung in Höhe von 120 % des von der anderen Partei aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die andere Partei vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.

Die Berufung wird zugelassen.
