Omnilex summary

The plaintiff brought a copyright infringement claim against the defendant based on an alleged infringement through the defendant's internet connection. The court held that the inference of the account holder's sole use, and thus presumed authorship, is dispelled once other family members are shown to share the household connection. The defendant's secondary burden extended only to a general description of the other users' internet habits, knowledge, and the results of inquiries. The rights holder could have called those users as witnesses, but their exercise of testimonial privilege left the plaintiff unable to prove that the defendant committed the infringement. The court dismissed the claim, charged the plaintiff costs, declared the judgment provisionally enforceable, and granted leave to appeal.

Omnilex headnote

UrhG Art. 97; ZPO Arts. 286 and 287; presumption of authorship and secondary burden of proof where a household internet connection is shared. The factual presumption that the account holder alone used the connection, and hence committed an infringement, is rebutted by proof that other family members live in the household and have access to it. The account holder's secondary burden is limited to general information reasonably available in that person's sphere: the other household members' ordinary use of the connection, their internet knowledge, and the outcome of inquiries concerning the infringement. The rights holder retains the burden of proving authorship and may call the other users as witnesses. If they refuse testimony under a testimonial privilege, that refusal does not shift the burden back to the account holder; the rights holder remains unproven as to authorship.

Dokumenttyp: Urteil

Spruchkörper: Abteilung 57

Normen: UrhG §97; ZPO §§286, 287

Leitsätze

The presumption that the account holder alone used the connection does not apply once other household family members are shown to share it; plaintiff did not prove the defendant's authorship.

The defendant's secondary burden required only a general account of other household members' usual internet use, internet knowledge, and the result of inquiries. The rights holder could call the other users as witnesses; when they exercised their right to refuse testimony, the plaintiff remained unable to prove authorship.

The plaintiff must bear the costs.

The claim was dismissed.

The judgment is provisionally enforceable; the plaintiff may avert enforcement by providing security of 120% of the enforceable amount, unless the defendant provides security of 120% of the amount to be enforced.

Leave to appeal was granted to the plaintiff.
