Die Beklagte wird verurteilt, an den Kläger 45,00 EUR (in Worten: fünfundvierzig Euro) zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits haben die Beklagte zu 4% und der Kläger zu 96% zu tragen.

Dieses Urteil ist vorläufig vollstreckbar.

Den Parteien hat das Gericht gestattet, die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abzuwenden, wenn nicht die jeweils andere Partei vor der Zwangsvollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leistet.
