hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 29.05.2017

durch die Richterin X

für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 400,00 EUR nebst Zinsen in Höhe von 5%-Punkten über dem jeweiligen Basiszinssatz seit dem 05.11.2016 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 20% und die Beklagte zu 80%.

Das Urteil ist vorläufig vollstreckbar. Der jeweilige Vollstreckungsschuldner kann die Vollstreckung des Vollstreckungsgläubigers durch Leistung einer Sicherheit in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der jeweilige Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leisten.

Die Berufung wird zugelassen.
