Leitsätze

Es ist zulässig, entsprechend der Option in Modul H des amtlichen Vollstreckungsauftrages gem. § 1 S. 1 GvFV einen Verhaftungsauftrag vorab zu erteilen und die Weiterleitung des Haftbefehls mit diesem Verhaftungsauftrag durch das Vollstreckungsgericht unmittelbar an den Gerichtsvollzieher zu beantragen. Es liegt insbesondere kein unzulässiger "bedingter Verhaftungsauftrag" vor. (Anschluss an LG Stuttgart DGVZ 2017, 174; AG Mannheim DGVZ 2017, 59).

wird auf die Erinnerung der Gläubigerseite vom 17.08.2017 der/die Gerichtsvollzieher/in L angewiesen, die Zwangsvollstreckung aus dem Vollstreckungsauftrag vom 06.04.2017 Modul H in Form der Verhaftung des Schuldners durch Vollzug des Haftbefehls vom 26.06.2017 fortzusetzen und nicht mit der Begründung zu verweigern, es bedürfte eines erneuten Auftrages unter Verwendung des amtlichen Formulares Modul I und der Einreichung einer aktualisierten Forderungsaufstellung.
