Das Verfahren wird eingestellt.

Das Urteil des Bayerischen Verwaltungsgerichtshofs vom 6. April 2006 und der Gerichtsbescheid des Bayerischen Verwaltungsgerichts München vom 5. August 2005 sind unwirksam, soweit sie den Widerruf der Flüchtlingsanerkennung des Klägers betreffen.

Die Kosten des Revisionsverfahrens und die Hälfte der Kosten des Verfahrens im ersten und zweiten Rechtszug werden gegeneinander aufgehoben. Im Übrigen verbleibt es bei der Kostenentscheidung zulasten des Klägers im Urteil des Bayerischen Verwaltungsgerichtshofs vom 6. April 2006.

Gründe

1 Nachdem die Beteiligten den - nach Aussetzung und Wiederaufnahme des Verfahrens unter dem Geschäftszeichen BVerwG 10 C 1.10 (bisher: 10 C 14.07) fortgesetzten - Rechtsstreit übereinstimmend in der Hauptsache für erledigt erklärt haben, ist das Verfahren, soweit es noch anhängig war (hinsichtlich des Widerrufs der Flüchtlingsanerkennung), in entsprechender Anwendung des § 92 Abs. 3 VwGO i.V.m. §§ 141, 125 Abs. 1 VwGO einzustellen. Zugleich ist insoweit die Unwirksamkeit der vorinstanzlichen Entscheidungen festzustellen und gemäß § 161 Abs. 2 VwGO über die Kosten des Verfahrens nach billigem Ermessen unter Berücksichtigung des bisherigen Sach- und Streitstandes zu entscheiden.

2 Billigem Ermessen entspricht es, die Kosten des Verfahrens, soweit es den Widerruf der Flüchtlingsanerkennung betraf, gegeneinander aufzuheben (§ 155 Abs. 1 Satz 1 VwGO). Der Senat hat dabei berücksichtigt, dass der Ausgang des Rechtsstreits bei Eintritt der Erledigung noch offen war, weil er von der noch ausstehenden Entscheidung des Gerichtshofs der Europäischen Union über die Vorabentscheidungsersuchen des Senats vom 7. Februar 2008 - BVerwG 10 C 33.07 u.a. - abhing. Er hat ferner berücksichtigt, dass die Einbürgerung des Klägers, die letztlich zur Erledigung des Rechtsstreits geführt hat, der Sphäre des Klägers zuzurechnen ist. Angesichts dieser Umstände entspricht es billigem Ermessen, die auf diesen Streitgegenstand entfallenden Kosten, d.h. die Kosten des Revisionsverfahrens und jeweils die Hälfte der Kosten des erst- und zweitinstanzlichen Verfahrens, gegeneinander aufzuheben.

3 Die andere Hälfte der Kosten des erst- und zweitinstanzlichen Verfahrens, die auf den Widerruf der Feststellung von Abschiebungsschutz nach § 53 Abs. 4 AuslG 1990 bzw. die negativen Feststellungen zu § 60 Abs. 2 bis 7 AufenthG in Nr. 1 und Nr. 3 des angefochtenen Bescheides entfallen, hat nach dem insoweit rechtskräftig gewordenen Urteil des Bayerischen Verwaltungsgerichtshofs vom 6. April 2006 der Kläger als Unterlegener zu tragen. Insoweit verbleibt es bei der Kostenentscheidung des Verwaltungsgerichtshofs.

4 Gerichtskosten werden gemäß § 83b AsylVfG nicht erhoben. Der Gegenstandswert ergibt sich aus § 30 Satz 1 RVG.
