Der Senat stimmt der Rechtsansicht des anfragenden 5. Strafsenats zu. Er gibt möglicherweise entgegenstehende eigene Rechtsprechung auf.

Gründe

1 Der 5. Strafsenat beabsichtigt zu entscheiden:

2 Auch bei fortbestehendem Verdacht einer Beteiligung an einer in § 138 Abs. 1 oder 2 StGB bezeichneten Katalogtat hindert der Zweifelssatz eine Verurteilung wegen Nichtanzeige geplanter Straftaten nicht.

3 Er hat daher bei den anderen Strafsenaten angefragt, ob diese an entgegenstehender Rechtsprechung festhalten.

4 Der 4. Strafsenat schließt sich der Rechtsauffassung des anfragenden Senats an und gibt eigene, möglicherweise entgegenstehende Rechtsprechung auf.

5 Er gibt jedoch zu bedenken, ob es zur Vermeidung von Missverständnissen nicht angezeigt sein könnte, die entscheidungserhebliche Rechtsfrage wie folgt zu fassen:

Eine Verurteilung wegen Nichtanzeige geplanter Straftaten hat nicht schon deshalb zu unterbleiben, weil der Verdacht der Beteiligung an einer in § 138 Abs. 1 und 2 StGB bezeichneten Katalogtat fortbesteht.
