Omnilex summary

The Federal Court held that a Rechtsbeschwerde against an OLG decision in EGGVG proceedings is inadmissible where the OLG did not expressly grant leave. The court treated the OLG's silence on the leave question as a refusal of leave, which is itself not open to challenge. The applicant's complaint was therefore dismissed as inadmissible and costs were imposed on the applicant.

Omnilex headnote

Aufl., § 29 EGGVG Rn. 2).

Key legal question

Whether the applicant's Rechtsbeschwerde was admissible despite the OLG's silence on leave to appeal.

Extracted holding

No. The silence of the Oberlandesgericht on leave to appeal counts as a refusal of leave, and that refusal is not challengeable.

Extracted reasoning

Under § 29(1) EGGVG the decision is not appealable. The OLG had to examine leave of office under § 29(2) EGGVG; if it does not grant leave expressly, the silence is treated as non-admission. That non-admission is itself not subject to review.
