Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Weiden i. d. OPf. vom 5. Februar 2013 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Die Rüge eines Verstoßes gegen § 252 StPO im Hinblick auf eine Handy-Videoaufnahme ist schon unzulässig. So ist nicht vorgetragen, ob die Tochter des Angeklagten in der Hauptverhandlung von ihrem Zeugnisverweigerungsrecht Gebrauch gemacht oder Entsprechendes eindeutig und bestimmt vorher erklärt hat bzw. ihre zur Entscheidung über die Verweigerung des Zeugnisses befugten Vertreter solches für sie getan haben. Aus dem Vortrag, dass sie bei ihrer Vernehmung vor dem Ermittlungsrichter die "Aussage verweigert" habe, ergibt sich dies nicht, da offen bleibt, in welchem Verfahren - wie der Senat den Urteilsausführungen entnehmen kann, gab es auch ein Verfahren wegen der Vorwürfe zum Nachteil dieser Tochter - die ermittlungsrichterliche Vernehmung erfolgt ist. Zudem genügt der Vortrag der Revision auch insoweit nicht den Anforderungen des § 344 Abs. 2 Satz 2 StPO, als offen bleibt, unter welchen Umständen die Handy-Videoaufnahme in den Besitz der Strafverfolgungsbehörden gelangt ist. Dies wäre indes erforderlich, um beurteilen zu können, ob sich das Verwertungsverbot des § 252 StPO überhaupt auf diese erstreckt (vgl. hierzu BGH, Beschluss vom 23. Oktober 2012 - 1 StR 137/12, NStZ 2013, 247 mwN).
