Omnilex summary

The claimant appealed in an employment dispute concerning the crediting of a period of service. The Federal Labour Court partially upheld the claimant's revision and rejected the defendant state's revision. It set aside the Berlin-Brandenburg Regional Labour Court's judgment in part and amended the Berlin Labour Court's judgment so that the period from 1 January 2004 to 30 June 2011 must also be taken into account. The defendant state was ordered to bear the costs of the proceedings.

Omnilex headnote

§ 313a Abs. 1 ZPO; where the parties waive statement of facts and reasons, the decision is issued accordingly. In revision, the Federal Labour Court may partially set aside the appellate judgment and amend the first-instance judgment if the contested period must additionally be taken into account; the successful party's claim is then to be granted to that extent, and costs follow the outcome of the litigation.
