Omnilex summary

The Federal Labour Court partly upheld the plaintiff's revision in a dispute against the defendant state. It set aside the judgment of the Berlin-Brandenburg Higher Labour Court in part and amended the Berlin Labour Court judgment so that the period from 1 January 2004 to 30 June 2011 must also be taken into account. The defendant's revision was dismissed. The defendant was ordered to bear the costs of the litigation.

Omnilex headnote

Employment law; recognition of service periods in a revision proceeding; if the appellate court's operative part is only partly incorrect, the Federal Labour Court may set it aside in part and amend the first-instance judgment accordingly. Where the plaintiff's appeal succeeds to that extent, the defendant bears the costs of the proceedings (cf. operative part; parties waived findings of fact and reasons under § 313a(1) ZPO).
