Omnilex summary

The Federal Labor Court partly corrected the operative part of the lower-court judgment in a wage dispute. It dismissed the defendant's appeal against the judgment of the Labor Court Ulm and upheld the award in substance, but held that statutory interest on the amount owed begins only on 2012-12-04. The defendant was ordered to bear the costs of the appeal and revision proceedings. The parties had waived a statement of facts and reasons under section 313a ZPO.

Omnilex headnote

§ 313a ZPO; where the parties waive a statement of facts and reasons, the judgment may be rendered without a detailed factual and legal exposition. In revision proceedings, the appellate court may uphold the lower-court judgment in substance while correcting only a limited part of the operative part, such as the commencement date for interest. A modification confined to the interest start date does not require disturbance of the merits outcome if the underlying monetary claim remains otherwise justified.
