1 Eine einheitliche Kostenentscheidung war nicht veranlasst. Bei Erfolglosigkeit beiderseitiger Rechtsmittel kann jedes dieser Rechtsmittel kostenmäßig gesondert beurteilt werden (Baumbach/Lauterbach/Albers/Hartmann, 71. Aufl. § 97 ZPO Rn. 36).
