Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Hamburg vom 9. Mai 2016 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend zur Antragsschrift des Generalbundesanwalts bemerkt der Senat:

Ein Verstoß gegen das Recht auf konfrontative Befragung nach Art. 6 Abs. 3 Buchst. d MRK und gegen das Recht auf ein faires Verfahren liegt nicht vor. Denn es ist der Justiz nicht zuzurechnen, dass der Mitangeklagte Fragen des Revisionsführers nicht beantwortet hat (vgl. BGH, Beschluss vom 9. Juni 2009 - 4 StR 461/08, NStZ 2009, 581; LR-StPO/Sander, 26. Aufl., § 261 Rn. 83e mwN).
