Tenor

Die Rechtsbeschwerde gegen den Beschluss des 6. Zivilsenats des Oberlandesgerichts Dresden vom 30. Mai 2017 wird auf Kosten des Beklagten als unzulässig verworfen.

Der Wert des Rechtsbeschwerdeverfahrens wird auf 15.000 € festgesetzt.

Gründe

1 Die Rechtsbeschwerde ist unzulässig, weil sie nicht binnen einer Notfrist von einem Monat nach Zustellung des angefochtenen Beschlusses durch einen bei dem Bundesgerichtshof zugelassenen Rechtsanwalt eingelegt worden ist (§ 575 Abs. 1 Satz 1 ZPO iVm § 78 Abs. 1 Satz 3 ZPO).

2 Der Beklagte selbst ist nicht postulationsfähig. Entgegen seiner Ansicht verstößt der § 78 Abs. 1 ZPO zu entnehmende Anwaltszwang nicht gegen höherrangiges Recht. Er dient der Qualität und dem Funktionieren des Rechtsschutzes und damit der verfassungsmäßigen Ordnung. Die Mitwirkung von Rechtsanwälten am Verfahren trägt wesentlich zur Ausschöpfung des tatsächlichen und rechtlichen Prozessstoffes bei. Sie führt außerdem zu einer Versachlichung des Rechtsstreits, die dem raschen und reibungslosen Prozessverlauf zugutekommt. Durch diese Zwecke ist die mit dem Anwaltszwang einhergehende Beschränkung der Parteirechte hinreichend sachlich gerechtfertigt und wegen der Möglichkeit der Bewilligung von Prozesskostenhilfe sowie der Beiordnung eines Anwalts gemäß den §§ 78b, 78c ZPO auch zumutbar (BGH, Beschluss vom 12. November 2014 - IX ZB 61/14, nv mwN).
