Key legal question

Whether the organ dispute application was effectively filed despite the representative's failure to prove authorization under § 22(2) BVerfGG.

Extracted holding

No. Without proof of authority, the application was not effectively pending before the Court.

Extracted reasoning

The Court held that the representative failed, even after repeated requests, to establish the required authorization. The presiding judge therefore noted the defect, and the Court refrained from further reasoning under § 24 sentence 2 BVerfGG.
