Omnilex summary

The First Senate’s Third Chamber of the Federal Constitutional Court dealt with a constitutional complaint concerning the allocation of press seats in the NSU proceedings. It refused legal aid and appointment of counsel because the complaint offered no sufficient prospect of success. The complaint was not admitted for decision pursuant to § 93d(1) sentence 3 BVerfGG. As a consequence, the request for an interim injunction also became moot. The decision is final and unappealable.

Omnilex headnote

§ 114 S. 1 ZPO analog; § 93d Abs. 1 S. 3 BVerfGG; constitutional complaint with no sufficient prospect of success: legal aid may be refused, and the complaint may be rejected without a reasoned decision. Where the main complaint is not admitted, a request for interim relief loses its independent object and need not be decided separately. The Chamber may dispense with a statement of reasons under the statutory exception for non-admission decisions.

Key legal question

Whether legal aid and appointment of counsel should be granted for the constitutional complaint

Extracted holding

No. The complaint had no sufficient prospect of success within the meaning of the analogous rule on legal aid.
