Omnilex summary

The Federal Constitutional Court declined to admit a constitutional complaint challenging a decision of the Saxony-Anhalt State Constitutional Court on the gender-neutral formulation of office titles. It held that no violation of rights under § 90(1) BVerfGG was discernible. The state court had found that the linguistic equality rule in § 159 KomVerfG ST also applies to the office of equal opportunities officer under § 78 KomVerfG ST and that men are not excluded from holding that office. The decision is final.

Omnilex headnote

Art. 3 Abs. 1 GG, § 90 Abs. 1 BVerfGG; linguistic equality of office titles and access to the office of equal opportunities officer: A constitutional complaint is not admitted where the challenged state-court interpretation of the relevant provisions does not reveal a possible violation of fundamental rights. If the law on gender-neutral language is applied to the office of equal opportunities officer and the office is open to men, no constitutionally relevant exclusion or unequal treatment is apparent. The Court may dispense with further reasoning under § 93d Abs. 1 sentence 3 BVerfGG.

Titelzeile

Nichtannahmebeschluss: Sprachliche Gleichstellung von Personen- und Funktionsbezeichnungen und Amt der Gleichstellungsbeauftragten (hier: gem §§ 78, 159 KomVerfG ST) - keine Grundrechtsverletzung

Tenor

Key legal question

Whether the constitutional complaint disclosed a violation of the complainant's rights under Art. 3(1) GG and § 90(1) BVerfGG.

Extracted holding

No rights violation was apparent; the complaint was not admitted.

Extracted reasoning

The state constitutional court had held that the statutory gender-neutral language rule also applies to the equal opportunities officer, and that men are not barred from holding that office.

Key legal question

Whether the interpretation of §§ 78 and 159 KomVerfG ST concerning linguistic equality and the office of equal opportunities officer was constitutionally objectionable.

Extracted holding

The interpretation raised no constitutional concern in the proceedings.

Extracted reasoning

Because the office is not limited to women, the challenged interpretation did not infringe equal treatment or any other cognizable constitutional right.
