Omnilex summary

The Federal Constitutional Court did not admit the constitutional complaint against the Cottbus Regional Court decision because the complainant had not exhausted the main proceedings remedies and had not shown any urgency for interim relief. The pending application for an interim injunction therefore became moot. The Court additionally pointed out that an obvious inadmissible interim application may trigger a misuse fee under § 34(2) BVerfGG.

Omnilex headnote

§ 90 Abs. 2 S. 1 BVerfGG; material subsidiarity of the constitutional complaint: A complainant must first exhaust the ordinary remedies in the main proceedings when this is reasonable. Interim relief under § 32 Abs. 1 BVerfGG requires substantiated urgency; a merely asserted or unsubstantiated need for urgent protection does not suffice. If an application for interim relief is obviously inadmissible, § 34 Abs. 2 BVerfGG allows consideration of a misuse fee. Further reasoning may be dispensed with under § 93d Abs. 1 sentence 3 BVerfGG.

Key legal question

Whether the constitutional complaint against the Regional Court decision was admissible despite non-exhaustion of the main proceedings remedies

Extracted holding

The complaint was not admitted because the principle of material subsidiarity barred review; the complainant had to exhaust the main proceedings first.

Extracted reasoning

It was reasonable to require exhaustion of the ordinary legal remedies in the main proceedings before constitutional review.

Key legal question

Whether the request for an interim injunction should be granted

Extracted holding

The request for interim relief became moot once the constitutional complaint was not admitted.

Extracted reasoning

Without admission of the main complaint, there was no basis for separate interim relief.

Key legal question

Whether a misuse fee could be imposed for filing an obviously inadmissible interim-relief request

Extracted holding

The Court merely noted the possibility of imposing a misuse fee under § 34(2) BVerfGG in such a case.

Extracted reasoning

The decision referred to the statutory possibility and a prior chamber decision; no fee was imposed here.
