Omnilex summary

The Federal Constitutional Court did not admit the constitutional complaint. It held that, even assuming the inability to confront witness A. and the anonymous witnesses was attributable to the German justice system, the criminal proceedings were fair overall. The Regional Court had adequately compensated the defense restriction in its assessment of the evidence by evaluating the disputed statements with marked caution and by relying its conviction primarily on other substantial evidence. The decision is final.

Art. 2 Abs. 1 GG, Art. 20 Abs. 3 GG, Art. 6 Abs. 1 S. 1 EMRK, Art. 6 Abs. 3 lit. d EMRK; § 250, § 251 StPO; fair-trial guarantee despite absence of confrontation with incriminating witness and use of anonymous testimony. A restriction of the defence right to confront witnesses does not in itself render criminal proceedings unfair. The decisive criterion is whether the proceedings as a whole remain fair. This requires, where confrontation is unavailable, that the evidentiary deficit be compensated in the assessment of proof, in particular by a careful and restrained appraisal of the contested statements and by reliance on further independent indicia of proof. If the conviction is not based mainly on the contested testimony, but on other substantial evidence, no constitutional violation arises (consid. 1).

Titelzeile

Key legal question

Whether the criminal proceedings remained fair despite the defendant's inability to confront witness A. and anonymous witnesses

Extracted holding

Yes. Even assuming the impossibility is attributable to the authorities, the proceedings as a whole remained fair.

Extracted reasoning

The lower court compensated the restriction on defense rights in the evaluation of evidence by treating the contested statements with exceptional caution and restraint and by not basing its conviction mainly on them, but on several other significant indicia of proof.
