Omnilex summary

The Federal Administrative Court allowed the revision in a civil-service damages dispute concerning alleged forfeiture of a claim arising from delayed or omitted promotion. It held that the case raises questions of fundamental significance regarding the requirements for the time and circumstance elements of forfeiture and also indicates divergence from the cited case law. The court further fixed the value in dispute for the complaint and provisional revision proceedings.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 and Nr. 2 VwGO; § 127 Nr. 1 BRRG; admission of revision in a civil-service damages case concerning forfeiture due to delayed or omitted promotion. Revision is to be admitted where the proceedings are capable of clarifying unresolved questions on the temporal and factual elements of forfeiture and where the challenged judgment departs from relevant comparative case law. For the admission stage, it suffices that the complaint plausibly identifies a question of general significance or a divergence relevant to the appeal; a full merits review is not required (consid. 1–2).
