MODIFICATION OF OPINION;
CORRECTION OF CLERICAL
ERROR
[NO CHANGE IN JUDGMENT]
THE COURT:
The opinion filed herein on December 3, 2001, is hereby modified as follows:
1. On page 2, line 13, insert before the phrase “and several others” the words
“Juan Rodriguez”, so the sentence reads:
Also present were Mario Martinez (the victim), Mona Estrada (a friend of
the victim), Marcela (Monica’s daughter), Amador Estrada IV (a neighbor
of Monica’s), Elizeth Manjarez (Amador’s girlfriend), Juan Rodriguez and
several others.
2. Delete all text beginning with line 12, page 18, and ending with line 19 on page
20, including footnote 13. Deletion of this footnote will require remaining footnotes to
be renumbered
3. On page 21, delete the sentence beginning on line 4 and ending on line 7, and
replace it with the following:

The record does not engender confidence in a finding that the trial court
engaged in a sincere and reasoned attempt to evaluate the prosecutor’s
justification for challenging Guerrero.
This modification does not effect a change in the judgment.
