This matter is before us following the Supreme Court’s reversal of the
judgment of this court. Upon receipt of the Supreme Court’s decision, we vacated our
judgment, recalled the mandate, and permitted the parties to file supplemental briefs.
Upon careful consideration of the Supreme Court’s decision and the parties’
supplemental briefs, this matter is REMANDED to the district court with instructions
to implement the Supreme Court’s determination that Officers Vick and Girdner are
