On August 2, 2024, counsel for appellant Aaron Moore filed a brief and motion to
withdraw pursuant to Anders v. California, 386 U.S. 738 (1967). On August 5, this court
issued a notice pursuant to Circuit Rule 51(b), informing Moore that his attorney had
moved to withdraw and explaining that he had 30 days, until September 4, to file any
response with the court. The court did not receive a response. On November 1, the
clerk’s office received the August 5 notice, returned in the mail. It thus appears that
Moore never received the order or knew that he had a deadline to respond to his
attorney’s filings. To give Moore an opportunity to respond to counsel’s Anders brief
and motion to withdraw,
IT IS ORDERED that this court’s order and judgment, issued November 1, 2024, are
VACATED. The clerk’s office will reissue its notice, giving Moore 30 days to respond to
counsel’s Anders brief. The clerk’s office will also send Moore a copy of counsel’s brief
and motion to withdraw.
