IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEBRASKA MATTHEW L. LEBER, individually, Plaintiff, vs. BRYAN MEDICAL CENTER, et al., Defendants. 8:25-CV-401 ORDER This matter is before the Court on the Court's own motion pursuant to 28 U.S.C. §§ 455(a) & (b), which set forth the circumstances in which a judge of the United States shall disqualify himself from a proceeding. I very recently received emergency medical treatment from Bryan Medical Center, and will require substantial follow-up treatment for some time. It would be inappropriate for me to continue presiding over claims against the defendants at the same time I am now depending on them for necessary medical care. Accordingly, this case could implicate the circumstances described in § 455(a), requiring my recusal. IT IS ORDERED that I recuse myself from this case and that the Clerk shall refer this matter to the Chief Judge for reassignment. Dated this 28th day of October, 2025. BY THE COURT: John M. Gerrard Senior United States District Judge 8:25-cv-00401-RFR-RCC Doc # 88 Filed: 10/28/25 Page 1 of 1 - Page ID # <pageID>
