Court of Appeals, State of Michigan
ORDER
MAXWELL DEVON SCHORNAGEL V WHITNEY ALLYSE SCHORNAGEL
Docket No. 382833
LC No. 2023-058988-DM
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The motion to waive fees is DENIED. Nevertheless, pursuant to the policy of the Court,
payment of the $375 entry fee shall not be pursued by the Clerk of the Court because the appeal must be
dismissed for lack of jurisdiction.
The claim of appeal is DISMISSED for lack of jurisdiction. The September 23, 2026 order, which
denied a motion for relief from judgment and correction of child support arrears, is not a final order
appealable by right. MCR 7.202(6)(a); MCR 7.203(A)(1). More specifically, contrary to appellant’s
jurisdictional checklist, the order is not final pursuant to MCR 7.202(6)(a)(iii) because it did not grant or
deny “a motion to change legal custody, physical custody, or domicile.” (Emphasis added.) Dismissal is
without prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all
requirements under the court rules and is not time-barred.
