In the Matter of the Teaching Certificate of
Sheila Tabanli, Central Jersey Prep Charter
School, Somerset County.
This matter was returned to the Department for disposition as consequence of
respondent’s failure to appear at a January 28, 2019 telephone prehearing conference. 	Pursuant to
N.J.A.C. 1:1-18.7(a), the Commissioner remands the matter to the Office of Administrative Law
(OAL) for further action in accordance with N.J.A.C. 1:1-14.4(c), for the reasons stated herein.
In this case, the petitioner is seeking to have the respondent’s certificate suspended
pursuant to N.J.S.A. 18A:26-10 for resigning without giving the notice required by her contract with
petitioner. Notably, the clerk returned this matter to the Department because the respondent did not
appear at the scheduled telephone conference. However, the petitioner – Central Jersey Prep Charter
School, who was the appearing party – is entitled to a decision on the merits. N.J.A.C. 1:1-14.4(d).
Accordingly, this matter is remanded to the Office of Administrative Law for further
action in accordance with N.J.A.C. 1:1-14.4(d).*
