filed October 22, 2026.
In The
Fifteenth Court of Appeals
NO. 15-24-00050-CV
TEXAS COMMISSION ON ENVIRONMENTAL QUALITY AND
GUADALUPE-BLANCO RIVER AUTHORITY, Appellants
V.
NATIONAL WILDLIFE FEDERATION, Appellee
On Appeal from the 98th District Court
Travis County, Texas
Trial Court Cause No. D-1-GN-20-007096
SUPPLEMENTAL MEMORANDUM OPINION
We issued an opinion in this case on March 10, 2026, affirming the
trial court’s judgment. A timely motion for rehearing was subsequently
filed. On October 7, 2026, the appellants filed an unopposed motion to
dismiss the appeal.
We grant the unopposed motion to dismiss, vacate our March 10,
2026 judgment, and dismiss the appeal. The parties have not requested that
2
we withdraw our March 10, 2026 opinion, and we do not do so. See Tex. R.
App. P. 42.1(c) (“In dismissing a proceeding, the appellate court will
determine whether to withdraw any opinion it has already issued.”).
Because no agreement as to costs has been made by the parties, we will tax
costs against the appellants. See id. R. 42.1(d) (“Absent agreement of the
parties, the court will tax costs against the appellant.”).
PER CURIAM
Panel consists of Chief Justice Brister and Justices Field and Farris
