COURT OF APPEALS EIGHTH DISTRICT OF TEXAS EL PASO, TEXAS ———————————— No. 08-26-00021-CR ———————————— Kody Lee Land, Appellant v. The State of Texas, Appellee On Appeal from the 20th District Court Milam County, Texas Trial Court No. CR26824 O R DE R Appellant’s brief was originally due on August 20, 2026. When no brief was timely filed, the clerk of this Court notified Appellant that failure to timely file a brief could result in an order remanding this appeal to the trial court for a hearing to determine Appellant’s indigency and, if necessary, to appoint new counsel to represent him in this appeal. After Appellant’s counsel failed
2 to file a brief, we abated this appeal and remanded the case. During the abatement, counsel for Appellant filed a motion for extension of time to file his appellate brief. Because counsel has moved for an extension, the hearing is no longer necessary. We REINSTATE this appeal, and we GRANT the motion for extension. Appellant’s brief is now due no later than October 30, 2026. Absent extraordinary circumstances, no further extension request will be considered. IT IS SO ORDERED this 20th day of October 2026. __________________________________________ MARIA SALAS MENDOZA, Chief Justice
