Ala. Admin. Code r. 580-7-37-.01 Motor Vehicle Registration

(1) All motor vehicles owned and/or operated by employees of the Department of Mental Health and Mental Retardation and used for transportation purposes to and from their respective facilities, must be registered with that facility's police department. Upon registration, employees will be issued a decal which will be placed on the registered vehicle in the manner prescribed by the facility's police department within twenty-four hours after issuance. There will be no charge for the decal.

(2) In order for a vehicle to be registered, a valid driver's license, evidence of ownership and evidence of liability insurance or financial responsibility must be shown. New employees will have ten (10) days from the date of employment to register vehicles. The registration of vehicles will become a part of the personnel hiring procedure.

(3) Any employee who is prevented from using his officially registered vehicle because of mechanical difficulties and desires to use another vehicle that is not registered, must obtain a temporary parking permit. Any temporary permit issued for mechanical difficulties will be valid for no more than one (1) week. Temporary parking permits may be applied for in the facility's police department office. There will be no charge for the issuance of a temporary parking permit. Must have a valid driver's license.

Ala. Admin. Code r. 580-7-37-.02 Parking And Traffic Rules

(1) All motor vehicles on campus must be registered and bear a valid decal.

(2) Driving or parking on the grass or sidewalks and parking or standing at cross walks, loading zones and yellow curbs is prohibited.

(3) Double parking or standing on streets or parking areas is prohibited at all times.

(4) Motor vehicles must be parked within the markers, if provided. Parking on or over a line or curb is prohibited.

(5) Motorists must yield to pedestrians at all times.

(6) Unnecessary or disturbing noise from horns and mufflers or any other noisemaking device is strictly prohibited at all times.

(7) Speed on campus streets is limited to 15 miles per hour except where otherwise posted. But any speed not safe for the condition of the road, including vehicular and pedestrian congestion, is prohibited.

(8) Parking will be in appropriately designated areas only.

(9) Blocking fire lanes, fire exits, parking within ten (10) feet of a fire hydrant is strictly prohibited at all times.

(10) All stop signs and yield right of way signs must be adhered to.

Ala. Admin. Code r. 580-7-37-.03 Penalties For Parking Violations

(1) First violation - warning.

(2) Second violation in any calendar year: Driving privileges revoked for 3 days.

(3) Third violation in any calendar year: Driving privileges revoked for 10 days.

(4) Fourth violation in any calendar year: Driving privileges revoked for 60 days.

Ala. Admin. Code r. 580-7-37-.04 Penalties For Moving Violations

(1) First violation - warning.

(2) Second violation in any calendar year: Driving privileges revoked for 30 days.

(3) Third violation in any calendar year: Driving privileges revoked for 60 days.

(4) Any subsequent violation within a calendar year will result in employee being subject to disciplinary action including suspension or dismissal.

Ala. Admin. Code r. 580-7-37-.05 Major Traffic Violations

Major traffic violations including driving under the influence, reckless driving, driving with no driver's license and driving while license is revoked shall result in issuance of standardized state traffic citations which will be handled through the state district court system.

Ala. Admin. Code r. 580-7-37-.06 Other Violations

(1) Any employee who obtains a decal under false pretense and/or allows someone else to register his/her vehicle shall have his/her driving privileges on campus revoked for two (2) weeks.

(2) All non-employees who violate any major moving traffic violations will be issued a standardized state traffic citation and/or subject to be arrested for trespass after warning.

(3) Any violation deemed a threat to the life of others may carry additional penalties to be determined by the facility director.

(4) Penalties for failure to register and/or proper display of decals will be the same as parking violation.

Ala. Admin. Code r. 580-7-37-.07 Appeal

An employee may appeal a Department of Mental Health and Mental Retardation traffic ticket in writing to the facility director within three (3) days of ticket issue date. The director or his/her designee shall hear the appeal. His/her decision will be final.
