RE: The tariff classification of a polystone bear ornament from China.

Dear Ms. Aldinger:

In your letter dated March 13, 1996, you requested a tariff classification ruling.

The submitted sample is a Polystone Bear Ornament, item #962649. It measures 3.5 inches long and 3.75 inches wide. The bear ornament is decorated with polystone letters that spell Merry Christmas. The bear is wearing a red hat that is decorated with gold stars and holding a horn. The polystone is a mixture of polystyrene and stone powder. A red satin ribbon is tied through a metal hook at the top of the ornament. This ruling is being issued on the assumption that you can produce proof that this item is bought and sold as a Christmas tree ornament.

The applicable subheading for the Polystone Bear Ornament will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
