RE:	The tariff classification of a gimped yarn from Italy.

Dear Ms. Mangiere:

	In your letter received in our office on April 19, 1996, on behalf of Lineapiu S.p.A. of Italy, you requested a tariff classification ruling.

	You have submitted a sample cone of yarn as follows: quality "Tiramolla" worsted yarn made of 88% polyamide and 12% Lycra (elastomeric spandex).  Our Customs laboratory has provided the following report:  "The sample is a gimped yarn."  As requested in your letter, the sample will be returned to you.

	The "Tiramolla" yarn will be classifiable under the provision for gimped yarn, and strip and the like of heading 5404 or 5405, gimped (other than those of heading 5605 and gimped horsehair yarn); containing elastomeric filaments, in subheading 5606.00.0010, Harmonized Tariff schedule of the United States (HTS).  The rate of duty will be 10.8 percent ad valorem.

	This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
