The Bern Cantonal High Court decided the accused's appeal against a first-instance conviction for multiple sexual acts with a child and attempts. Der sexuelle Charakter einer Handlung ist nach den Umständen des Einzelfalls zu bestimmen.

Die Vorinstanz sprach den Angeschuldigten schuldig der mehrfachen sexuellen Handlungen mit Kind und Versuchs dazu schuldig und verurteilte ihn zu einer Geldstrafe von 240 Tagessätzen à Fr. 110.00, bedingt erlassen bei einer Probezeit von zwei Jahren sowie zur Bezahlung einer Genugtuung von Fr. 3'000.00. Dagegen erklärte der Angeschuldigte die Appellation. Die Kammer bestätigte den erstinstanzlichen Schuldspruch. Die Geldstrafe wurde auf 120 Tagessätze à Fr. 130.00 und die Genugtuung auf Fr. 1'000.00 reduziert.

Das Bundesgericht hat in 125 IV 63 zwar gesagt, dass u.a. das Küssen auf den Mund in der Regel keine sexuelle Handlung sei. Es hat dies aber nur als Regel festgehalten und weiter auch gesagt, dass man in Zweifelsfällen nach den Umständen des Einzelfalles die Erheblichkeit auch relativ wird bestimmen müssen, so etwa nach dem Alter des Opfers oder dem Altersunterschied. Entsprechend hat das Bundesgericht das Berühren eines Beines und Oberschenkels bzw. den Versuch einer Umarmung und eines Kusses als sexuelle Handlung qualifiziert, dies auf dem Hintergrund vorausgegangener Ereignisse, bei welchem sich der Täter dem Opfer über längere Zeit hinweg aufgedrängt und es schliesslich zu vergewaltigen versucht hatte.

Auf dem Hintergrund obiger Rechtsprechung muss der Kussversuch von A. am frühen Morgen in der Dunkelheit beim Schulhaus beim 14 Jahre jüngeren B., bei welchem er bereits unter zwei Malen Übergriffe vorgenommen hatte, als (versuchte) sexuelle Handlung qualifiziert werden.

Dass A. auch den subjektiven Tatbestand erfüllt hat, ist offensichtlich. Er ist deshalb wie in erster Instanz der sexuellen Handlungen mit Kindern und des Versuchs dazu, mehrfach begangen in den drei Fällen gemäss Überweisungsbeschluss, schuldig zu erklären.
