The Swiss Baugesellschaft complained against an arrest order issued in Zell, canton Lucerne, at the request of the Häberli brothers for an alleged CHF 120 claim. The Federal Court treated the appellant’s assertions as admitted because the respondents did not file an answer. It held that the appellant was a Swiss citizen domiciled in Bern and that the arrest therefore violated Art. 59 BV, which bars arrest of a domiciled Swiss citizen’s assets outside the canton of residence. The complaint was upheld and the arrest annulled. The Court also found the arrest reckless and imposed court fees and party compensation on the arresting creditors.

Where the respondent does not contest the complaint, the asserted facts may be treated as admitted. If the debtor is a Swiss citizen duly domiciled in another canton, an arrest on his assets outside the canton of domicile is unconstitutional and must be annulled. A reckless arrest justifies the allocation of court costs and party compensation against the arresting creditor.
Urtheil vom 18. Februar 1876 in Sachen der schweizerischen Baugesellschaft. A. Mit Eingabe vom 20. November v. Js. beschwerte die schweizerische Baugesellschaft in Bern, bestehend aus den Herren J. C. Baur in Bern, H. Egger in Langenthal und G. Ott. in Bern, sich darüber, daß der Gerichtspräsident von Zell, Kanton Luzern, unterem 31. Oktober v. Js. auf Begehren der Gebrüder Häberli im Krummacker bei Altbüron für eine angebliche Forderung derselben von 120 Fr. an die Baugesellschaft, als Unternehmerin des Staltentunnels an der Eisenbahnlinie Langenthal-Wauwyl, einen Rollwagen mit Arrest belegt habe. Recurrentin behauptete, es liege darin eine Verletzung des Art. 59 der Bundesverfassung, indem sie aufrechtstehend und in Bern domicilirt sei. B. Die Gebrüder Häberli ließen die ihnen zur Beantwortung der Beschwerde angesetzte Frist, welche mit der Androhung verbunden war, daß sonst auf Grundlage der vorliegenden Acten entschieden würde, unbenutzt verstreichen. Das Bundesgericht zieht in Erwägung:
Da die Recursbeklagten die Beschwerdeschrift nicht beant wortet haben, so sind die in derselben behaupteten Thatsachen, daß Recurrentin aufrechtstehend und in Bern domicilirt sei, als anerkannt zu betrachten.
Hienach verstößt der gelegte Arrest allerdings gegen Art. 59 der Bundesverfassung und muß demnach als verfassungs widrig aufgehoben werden, indem nach der bezeichneten Verfassungsbestimmung auf das Vermögen eines aufrechtstehenden Schweizerbürgers außer dem Canton, in welchem er wohnt, kein Arrest gelegt werden darf.
Die Arrestlegung erscheint als eine leichtfertige, welche es rechtfertigt, den Arrestklägern eine Gerichtsgebühr, sowie eine Parteientschädigung aufzulegen. Demnach hat das Bundesgericht erkannt: Die Beschwerde ist begründet und demnach der vom Gerichts präsidium Zell unterm 31. Oktober 1875 auf Begehren der Gebrüder Häberli gegen die Recurrentin verfügte Arrest auf gehoben.
