Häller sought CHF 6,000 from the State of Lucerne for allegedly unlawful detention. The Lucerne High Court rejected the claim, and Häller appealed to the Federal Court. The Federal Court held that the asserted liability of a canton for damage caused by its officials in the exercise of non-commercial public functions does not arise from federal private law, in particular not from Arts. 50 ff. OR, because Art. 76 OR reserves such matters to other legislation. As the dispute therefore did not involve the application of federal civil law, the appeal was not open under Art. 56 OG and the Federal Court did not enter into it.

  1. Arteil vom 21. Mai 1909 in Sachen Häller, Kl. u. Ber. Kl., gegen Staat Inzern, Bekl. u. Ber. Bekl. Mangel des Berufungserfordernisses der Anwendbarkeit eidgen. Zivil rechts: Art. 56 0G. Die Haftbarkeit eines Kantons für Schaden, den seine Beamten oder Angestellten in Ausübung ihrer (nicht gewerb lichen) Funktionen stiften, lässt sich gemäss Art. 76 OR nicht aus dem eidgen. Zivilrecht, insbesondere nicht aus den Art. 50 ff. OR, ableiten. Das Bundesgericht hat auf Grund folgender Prozeßlage: A. Durch Urteil vom 16. Januar 1909 hat das Ober gericht des Kantons Luzern eine Entschädigungsforderung des Klägers Häller gegen den Staat Luzern von 6000 Fr., nebst 5% seit 22. Juni 1906, wegen ungesetzlicher und ungerechtfer tigter Verhaftung zufolge Anordnung des Statthalteradjunkts des Amts Luzern Land, gänzlich abgewiesen. B. Gegen dieses Urteil hat der Kläger rechtzeitig die Be rufung an das Bundesgericht erklärt und seine Klageforderung im vollen Umfange aufrecht erhalten; in Erwägung: Der Kläger stützt seinen Entschädigungsanspruch einerseits auf die Art. 50 ff. OR, und anderseits auf das luzernische Gesetz über die Verantwortlichkeit der Behörden und Beamten vom
  2. Oktober 1842, sowie auf die Bestimmung des 5 Abs. 4 luz. StsV, in Verbindung mit 313 des kantonalen StrV. Von diesen Rechtstiteln fällt für das Bundesgericht als Berufungs instanz gemäß Art. 56 OG nur die Anrufung der ersterwähnten eidgenössischen Privatrechtsnormen über die unerlaubten Hand lungen in Betracht. Hieraus aber kann, wie die Vorinstanz zu treffend ausgeführt hat, eine Verantwortlichkeit des Staates für Schaden, den seine Beamten oder Angestellten in Ausübung ihrer (nicht gewerblichen) Funktionen stiften, nicht hergeleitet werden. Denn bezüglich dieser, ihrer Natur nach dem öffentlichen Rechte angehörenden Verantwortlichkeit ist in Art. 76 OR ausdrücklich die anderweitige Gesetzgebung vorbehalten (vergl. Hafners Kom.,
  3. Aufl., Anm. 4 zu Art. 76 und Anm. 4 zu Art. 64 OR). Die vorliegende Streitsache beschlägt somit in keiner Hinsicht die Anwendung eidgenössischen Privatrechts und ist deshalb der Nach prüfung des Berufungsrichters entzogen; - erkannt: Auf die Berufung des Klägers wird nicht eingetreten.
