The Municipal Council of Kirchberg filed a precautionary appeal against a Federal Administrative Court judgment concerning facilitated naturalization, but did not submit any reasoning within the statutory deadline. The Federal Supreme Court held that the deadline could not be extended and that the appeal failed to meet the mandatory reasoning requirement. It therefore declined to enter into the appeal in simplified proceedings and ordered that no costs be charged.

Where the reasoning defect is manifest, the court may decide in simplified proceedings and declare the appeal inadmissible without calling for observations. Under Art. 47 Abs. 1 BGG, statutory deadlines cannot be extended. Court costs may be waived under Art. 66 Abs. 1 and 4 BGG.

Erwägungen:

Der Gemeinderat Kirchberg erhob mit Eingabe vom 1. Dezember 2008 "vorsorglich Beschwerde" gegen das Urteil des Bundesverwaltungsgerichts, Abteilung III, vom 4. November 2008. Gleichzeitig ersuchte er um Erstreckung der Beschwerdefrist bis 31. Dezember 2008 zur Einreichung einer Beschwerdebegründung. Das Bundesgericht teilte dem Gemeinderat mit Schreiben vom 2. Dezember 2008 mit, dass die Beschwerdefrist als eine gesetzlich bestimmte Frist nicht erstreckt werden könne (Art. 47 Abs. 1 BGG). In der Folge reichte der Gemeinderat innert der Beschwerdefrist keine Beschwerdeergänzung mehr ein. Das Bundesgericht verzichtet auf die Einholung von Vernehmlassungen.

Nach Art. 42 Abs. 2 BGG ist in der Begründung einer Beschwerde in gedrängter Form darzulegen, inwiefern der angefochtene Entscheid Recht verletzt. Art. 95 ff. BGG nennt die vor Bundesgericht zulässigen Beschwerdegründe.
Die Eingabe vom 1. Dezember 2008 enthält keine Beschwerdebegründung. Der Beschwerdeführer legt folglich nicht dar, inwiefern das Bundesverwaltungsgericht Recht verletzt haben sollte, als es die Beschwerde der Gemeinde abwies. Mangels einer genügenden Begründung im Sinne von Art. 42 Abs. 2 BGG ist somit auf die Beschwerde nicht einzutreten. Der Begründungsmangel ist offensichtlich, weshalb über die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. b BGG entschieden werden kann.

Kosten sind keine zu erheben (Art. 66 Abs. 1 und 4 BGG).
Demnach erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.
2.
Es werden keine Kosten erhoben.
3.
Dieses Urteil wird den Parteien, dem Bundesamt für Migration und dem Bundesverwaltungsgericht, Abteilung III, schriftlich mitgeteilt.
