The appellant filed a public-law appeal against the Bern tax appeal commission’s decision on military service exemption tax for 2006, then withdrew the appeal in writing. The Federal Supreme Court therefore discontinued the proceedings by order. It held that the appellant must bear the federal court costs and set them at CHF 200. No party compensation was awarded. The request for reimbursement of the cost advance was not granted in the dispositive part.

If the appellant withdraws the appeal, the Federal Supreme Court removes the case from the docket by order under the simplified procedure. In such a case, the court still decides on the costs of the federal proceedings and determines any party compensation pursuant to Art. 5 Abs. 2 BZP in conjunction with Art. 71 BGG. As a rule, the withdrawing appellant bears the court costs under Art. 65 and Art. 66 Abs. 1 and 3 BGG and has no entitlement to party compensation under Art. 68 Abs. 1 and 2 BGG.

in das Schreiben des Beschwerdeführers vom 24. Februar 2009, womit er die Beschwerde zurückzieht und um (allfällige) Rückerstattung des getätigten Kostenvorschusses ersucht,
in Erwägung,
dass das Verfahren gestützt auf Art. 32 Abs. 2 BGG mit Verfügung des Instruktionsrichters bzw. des Abteilungspräsidenten (vgl. Art. 32 Abs. 1 BGG) abgeschrieben werden kann, wobei über die Gerichtskosten zu entscheiden und die Höhe einer allfälligen Parteientschädigung zu bestimmen ist (Art. 5 Abs. 2 BZP in Verbindung mit Art. 71 BGG),
dass die Kosten des bundesgerichtlichen Verfahrens (Art. 65 BGG) dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 und 3 BGG) und er keinen Anspruch auf Parteientschädigung hat (Art. 68 Abs. 1 und 2 BGG),
verfügt der Präsident:

Das Verfahren wird infolge Rückzugs der Beschwerde abgeschrieben.

Die Gerichtskosten von Fr. 200.-- werden dem Beschwerdeführer auferlegt.

Diese Verfügung wird dem Beschwerdeführer, dem Amt für Militär und Bevölkerungsschutz des Kantons Bern, der Steuerrekurskommission des Kantons Bern und der Eidgenössischen Steuerverwaltung schriftlich mitgeteilt.
