Art. 29a BV did not require immediate cantonal legislative adaptation before the transitional deadline. Under Art. 130(3) BGG, the cantons had until 1 January 2009 to enact implementing rules. Since Aargau brought the new rules into force only on that date, the administrative court was allowed to rely on §§ 51 ff. aVRPG and decline jurisdiction except for limited procedural complaints.
