X. appealed to the Federal Supreme Court against a Geneva lease-appeal judgment concerning termination of a tenancy. Before the Federal Court ruled on the merits, X. withdrew the appeal by letter of 8 July 2009. The President accordingly ordered the case removed from the docket under Art. 32(2) LTF and charged CHF 300 in judicial costs to the appellant. The withdrawal ended the proceedings without any substantive review of the cantonal judgment.
Art. 32 al. 2 LTF; withdrawal of the appeal and procedural consequences. When a recourse is withdrawn, the President may strike the case from the docket without a merits decision. The withdrawal terminates the proceedings; in principle, the withdrawing party bears the judicial costs. The order is a procedural disposal limited to the consequences of the withdrawal and does not address the substance of the challenged judgment.

The appeal was struck from the docket following the withdrawal.
Under Art. 32(2) LTF, the President could note the withdrawal and terminate the proceedings by removing the case from the docket.
Allocation of federal court costs after withdrawal of the appeal
