The appellant in a civil employment dispute withdrew his appeal before the Federal Supreme Court after being ordered to pay an advance on costs and after his request for legal aid had been rejected. The single judge of the First Civil Law Court took formal note of the withdrawal, struck the case from the roll, and charged the appellant CHF 300 in judicial fees. The merits of the underlying unfair dismissal and indemnity dispute were not examined.
Art. 32 al. 2 LTF; withdrawal of an appeal before the Federal Supreme Court; once the appellant validly withdraws the remedy, the court takes note thereof and strikes the case from the roll without adjudicating the merits. Art. 66 al. 2 LTF; the withdrawing party may be charged with the judicial costs. The withdrawal renders the appeal moot in substance; only the procedural consequences, including costs, remain to be decided.

Vu la lettre du 12 septembre 2012 par laquelle le mandataire du recourant déclare retirer le recours au nom de son client;
Considérant qu'il y a lieu de prendre acte de ce retrait et de rayer la cause du rôle (art. 32 al. 2 LTF);
Vu, quant aux frais, l'art. 66 al. 2 LTF;
ordonne:

Il est pris acte du retrait du recours.
