The appellant withdrew her appeal against the Zurich Commercial Court judgment in a motor vehicle owner liability dispute. The Federal Supreme Court therefore struck the proceedings from the docket under Art. 32(2) BGG. It ordered reduced court costs of CHF 500 against the appellant under Art. 66(2) and (3) BGG.
Art. 32 Abs. 2 BGG; withdrawal of the appeal renders the proceedings moot and leads to striking out of the case. Where the appeal is withdrawn, the Federal Supreme Court terminates the proceedings without examining the merits and may, taking account of the circumstances, impose reduced court costs on the withdrawing appellant pursuant to Art. 66 Abs. 2 and 3 BGG.
