X.________ AG filed a civil appeal against a judgment of the Zurich Commercial Court and requested suspensive effect. The Federal Supreme Court first rejected the suspensive-effect request. It then ordered an advance on costs, later granted an extension, and warned that failure to pay would lead to non-entry. Because the appellant still did not pay within the extended deadline, the Court did not enter into the appeal. The Court also held that the appellant must bear the costs and pay party compensation to the respondent; it rejected the respondent's view that company organ persons or other involved persons could be held jointly liable for the compensation.
Art. 63 Abs. 2 BGG; non-payment of the advance on costs after warning and expiry of the grace period results in non-entry into the appeal. Under Art. 66 Abs. 3 BGG, costs are imposed on the party causing the proceedings to fail. Under Art. 68 Abs. 1, 2 and 4 BGG, party compensation is owed by the procedural party itself; the statute does not allow ordering corporate organs or other non-party persons jointly liable for such compensation.

In Erwägung,
dass die Beschwerdeführerin am 7. Dezember 2007 gegen das Urteil des Handelsgerichts des Kantons Zürich vom 5. November 2007 Beschwerde in Zivilsachen einreichte und um Gewährung der aufschiebenden Wirkung ersuchte;
dass die Beschwerdeführerin mit Verfügung vom 11. Dezember 2007 aufgefordert wurde, bis am 11. Januar 2008 einen Kostenvorschuss von Fr. 7'500.-- einzuzahlen;
dass die Beschwerdegegnerin am 11. Dezember 2007 aufgefordert wurde, bis am 11. Januar 2008 zum Gesuch um aufschiebende Wirkung und bis am 28. Januar 2008 zur Beschwerde Stellung zu nehmen;
dass die Frist zur Einreichung der Beschwerdeantwort auf Gesuch der Beschwerdegegnerin mit Verfügung vom 18. Januar 2008 bis zum 7. Februar 2008 erstreckt wurde;
dass die Beschwerdegegnerin am 14. Dezember 2007 eine Stellungnahme zum Gesuch um aufschiebende Wirkung einreichte, mit der sie dessen Abweisung beantragte;
dass das Gesuch um aufschiebende Wirkung mit Präsidialverfügung vom 3. Januar 2008 abgewiesen wurde;
dass die Beschwerdeführerin den verlangten Kostenvorschuss innerhalb der ihr bis 11. Januar 2008 angesetzten Frist nicht einzahlte, worauf ihr mit Verfügung vom 18. Januar 2008 in Anwendung von Art. 63 Abs. 2 BGG eine Nachfrist bis zum 4. Februar 2008 angesetzt wurde mit dem Hinweis, dass auf die Beschwerde nicht eingetreten werde, falls der Kostenvorschuss innerhalb der angesetzten Frist nicht bezahlt werde;
dass die Beschwerdeführerin den verlangten Kostenvorschuss auch innerhalb der ihr angesetzten Nachfrist nicht bezahlt hat, weshalb in Anwendung von Art. 63 Abs. 2 BGG auf ihre Beschwerde nicht einzutreten ist;
dass die Beschwerdeführerin gemäss dem Verursacherprinzip kosten- und entschädigungspflichtig ist (Art. 66 Abs. 3 und 68 Abs. 4 BGG);
dass Schuldnerin der Parteientschädigung gemäss dem Wortlaut des Gesetzes die am Verfahren beteiligte Partei ist (Art. 68 Abs. 1 und 2 BGG), weshalb entgegen der Auffassung der Beschwerdegegnerin, die sie in ihrer Beschwerdeantwort vom 6. Februar 2008 vertritt (S. 14 unten), nicht die Möglichkeit besteht, die Organpersonen der Beschwerdeführerin und "weitere in die Beschwerdeerhebung involvierte Personen" solidarisch mit der Beschwerdeführerin zur Zahlung der Parteientschädigung zu verpflichten;
erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.
2.
Die Gerichtskosten von Fr. 500.-- werden der Beschwerdeführerin auferlegt.
3.
Die Beschwerdeführerin hat die Beschwerdegegnerin für das bundesgerichtliche Verfahren mit Fr. 8'500.-- zu entschädigen.
4.
Dieses Urteil wird den Parteien und dem Handelsgericht des Kantons Zürich schriftlich mitgeteilt.

Whether the civil appeal should be admitted despite non-payment of the advance costs
The appeal could not be entered into because the appellant did not pay the required advance costs even within the extended deadline.
Under Art. 63(2) BGG, failure to pay the ordered advance costs after a warning and grace period leads to non-entry.
Who must bear the federal court costs
The appellant must bear the court costs.
Costs follow the event and are imposed on the party whose conduct caused the proceedings to fail.
Who owes the respondent's party compensation
Only the participating party, not its corporate organs or other involved persons, can be ordered to pay party compensation.
According to the wording of Art. 68 BGG, the duty to compensate lies with the party to the proceedings; personal liability of organ persons is not available here.
