The appellants filed a civil appeal against a judgment of the Ticino Court of Appeal, then withdrew the appeal by letter of 22 August 2011. The Federal Supreme Court, acting through its President as single judge, struck the case from the docket and ordered the appellants to pay court costs of CHF 300. The respondent took no substantive procedural step requiring a merits decision.

Upon withdrawal of the appeal, the President of the court or the instructing judge decides as single judge on removal from the docket and on the allocation of costs. In such a situation, the proceedings are terminated without a merits ruling, and the withdrawing appellants normally bear the judicial costs; the amount is fixed in the cost order.

che con scritto del 22 agosto 2011 i ricorrenti hanno dichiarato di ritirare il ricorso;
che il presidente della Corte, o il giudice dell'istruzione, decide quale giudice unico circa lo stralcio delle cause ritirate (art. 32 cpv. 1 e 2 LTF) e, in tale ambito, statuisce sulle spese giudiziarie (art. 5 cpv. 2 PC in relazione con l'art. 71 LTF);
che le spese giudiziarie sono poste a carico dei ricorrenti (art. 66 cpv. 1 LTF);
per questi motivi, la Presidente decreta:

La causa è stralciata dai ruoli a seguito del ritiro del ricorso.
2.
Le spese giudiziarie di fr. 300.-- sono poste a carico dei ricorrenti.
3.
Comunicazione alle parti e alla III Camera civile del Tribunale d'appello del Cantone Ticino.

Whether the withdrawn appeal should be struck from the docket
The case is struck out following the withdrawal of the appeal.
Once the appellants declared withdrawal, the single judge could order removal from the docket under Art. 32 paras. 1-2 LTF.
Allocation of court costs after withdrawal
Court costs of CHF 300 are charged to the appellants.
Costs are imposed on the withdrawing appellants under Art. 66 para. 1 LTF, with the judge competent to decide costs in such cases.
