Résumé Omnilex

The tenants challenged the Basel-Stadt appellate judgment in a federal constitutional complaint concerning rent repayment and related claims. The Federal Supreme Court held that the filing was untimely because the 30-day period had expired before the complaint was handed to the post. It further held that the submission was inadmissible because it contained no sufficient constitutional reasoning. The court therefore did not enter into the complaint and waived court costs.

Regeste Omnilex

Art. 100 Abs. 1, Art. 44 Abs. 1 and Art. 48 Abs. 1 BGG; subsidiary constitutional complaint; timeliness and substantiation requirements. A federal complaint is inadmissible if it is not handed over to the postal service by the last day of the statutory appeal period. For a subsidiary constitutional complaint, the appellant must specifically indicate which constitutional guarantees were violated and in what respect; a mere reference to the challenged decision is insufficient. Failure to satisfy either requirement leads to non-entry under Art. 108 Abs. 1 BGG. The court may waive costs under Art. 66 Abs. 1 BGG in the circumstances of the case.

Verfassungsbeschwerde gegen das Urteil des Appellationsgerichts des Kantons Basel-Stadt, Ausschuss, vom 26. September 2007.

In Erwägung,
dass das Zivilgericht von Basel-Stadt die von den Beschwerdeführern gegen die Beschwerdegegnerin erhobene Klage auf Zahlung von Fr. 980.-- (Rückforderung Mietzins Februar 2006), Fr. 2'000.-- (Anwaltskosten) und Fr. 2'020.-- (Inkonvenienzentschädigung) mit Entscheid vom 27. Juni 2007 abwies;
dass die Beschwerdeführer an das Appellationsgericht des Kantons Basel-Stadt gelangten, dessen Ausschuss die Beschwerde mit Entscheid vom 26. September 2007 abwies, soweit darauf eingetreten wurde;
dass die Beschwerdeführer dem Bundesgericht eine vom 22. Mai 2008 datierte Eingabe einreichten, in der sie erklärten, den Entscheid des Appellationsgerichts vom 26. September 2007 mit Beschwerde anzufechten;

dass unter den gegebenen Umständen auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 BGG);

erkennt der Präsident:

Question juridique clé

Whether the constitutional complaint was filed within the 30-day time limit.

Solution extraite

The complaint was filed too late because the deadline expired on 2008-05-22 and the filing was handed to the post only on 2008-05-23.

Motifs extraits

The challenged appellate decision was reportedly served on 2008-04-22; the 30-day period began on 2008-04-23 and ended on 2008-05-22. Under the postal dispatch rule, the complaint had to be handed over by that date.

Question juridique clé

Whether the filing met the reasoning requirements for a subsidiary constitutional complaint.

Solution extraite

No; the filing did not explain at all how the appellate decision violated constitutional norms.

Motifs extraits

The submission lacked any specific reference to federal or cantonal constitutional provisions and therefore failed to satisfy the required reasoning under the BGG.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court costs were imposed in view of the circumstances.

Motifs extraits

The court exercised its discretion to waive costs.
