The Federal Tribunal held that the public-law appeal against the Ticino Court of Appeal had become moot because, on the same day, the parallel appeal in reform was upheld and the challenged judgment was modified in the appellant’s favor. The appeal was therefore struck off the list. Applying the rules on moot proceedings, the Court ordered the appellant to bear the court fee of CHF 1,000, and it did not award costs to the respondents because their response had been extremely brief and essentially duplicated in the parallel proceedings.
Art. 72 PC in connection with Art. 40 OG; mootness of proceedings and allocation of costs: where a pending remedy becomes devoid of object because the parallel ordinary remedy succeeds and the impugned judgment is altered accordingly, the Federal Tribunal strikes the public-law appeal from the roll. For costs, it considers the situation before the event causing mootness; if the redundant remedy was unnecessary, procedural costs may be imposed on the appellant. No indemnity is awarded to respondents when their response is merely cursory and duplicative (consid. 1).

ricorso di diritto pubblico [OG] contro la sentenza emanata il 24 luglio 2006 dalla I Camera civile del Tribunale d'appello del Cantone Ticino.
Ritenuto in fatto e considerando in diritto:
che, in applicazione dell'art. 132 cpv. 1 LTF, la procedura ricorsuale in esame rimane disciplinata dall'OG, la sentenza impugnata essendo stata pronunciata prima dell'entrata in vigore della Legge sul Tribunale federale (LTF, RS 173.110; RU 2006 1205, 1241);
che in data odierna il parallelo ricorso per riforma è stato accolto e la sentenza impugnata è stata modificata nel senso auspicato dal ricorrente;
che in queste circostanze il presente ricorso di diritto pubblico è divenuto senza oggetto;
che giusta l'art. 72 PC, applicabile in virtù del rinvio di cui all'art. 40 OG, qualora una lite divenga senza oggetto il Tribunale federale statuisce sulle spese, tenendo conto dello stato delle cose prima del verificarsi del motivo che comporta il termine della lite;
che, rivelandosi il secondo rimedio superfluo, si giustifica di porre le spese processuali a carico del ricorrente (art. 156 cpv. 6 OG);
che si può invece prescindere dall'assegnazione di ripetibili alle controparti, avendo esse introdotto una risposta estremamente succinta, identica peraltro a quella presentata nel quadro del parallelo procedimento.
Il Tribunale federale decide:
1.
Il ricorso di diritto pubblico è stralciato dai ruoli perché divenuto privo d'oggetto.
2.
La tassa di giustizia di fr. 1'000.-- è posta a carico del ricorrente.
3.
Comunicazione ai patrocinatori delle parti e alla I Camera civile del Tribunale d'appello del Cantone Ticino.

The appeal had become moot and was struck off the list.
Since the parallel remedy was granted and the lower judgment was changed as requested, the public-law appeal no longer had any предмет to be decided.
