In a civil bankruptcy appeal, the appellant withdrew the appeal after the Federal Supreme Court had already refused suspensive effect. The President took note of the withdrawal and ordered the case struck from the docket. The appellant was ordered to pay judicial costs of CHF 300.
Art. 71 LTF in conjunction with Art. 73 PCF and Art. 32 al. 2 LTF; withdrawal of the appeal and striking the case from the docket. Upon a valid withdrawal declaration, the court merely takes note of the withdrawal and removes the case from the docket. Costs are allocated against the withdrawing party pursuant to Art. 66 para. 1 and 2 LTF in conjunction with Art. 71 LTF and Art. 5 para. 2 PCF.

par ces motifs, le Président ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.
